Dear SCL(S) members,

At the time of writing this message, Anil Changaroth (SCL(S)’s “International Liaison”) and myself have just returned from Sao Paulo, Brazil, where we were privileged to represent SCL(S) at the SCL International Conference 2016. The international conference was a special occasion in which Anil, as a speaker, and myself, as a session moderator, were able to showcase the sophistication of Singapore construction law on a world stage. This is highly relevant considering the development of construction law (and corresponding contractual and technical aspects of construction practice) throughout South America in general. It is also pleasing that SCL(S) can play an active role in the growth of the global SCL community.

 
 
 
 

Arbitrating Construction Disputes – The Problem Of Consolidation


Construction disputes often involve more than on party and more than one contract. This can lead to so-called "parallel proceedings" and is frequently cited as a source of concern by users of arbitration in the industry. In recent years, a number of arbitration institutions have included joinder and consolidation provisions in their arbitration rules (including, most recently, the Singapore International Arbitration Centre (the "SIAC") in the 6th Edition of the SIAC Rules (the "SIAC Rules 2016")). Rob Palmer and Sinyee Ong discuss the issue of consolidation in construction arbitration, the relevant provisions contained in the SIAC Rules 2016, and the implications for those drafting construction contracts.

Singapore Construction Industry Updates – July 2016

BCA launches Universal Design Week 2016

On 26 July 2016 BCA launched the 3rd Universal Design Week which focused on Universal Design in public with emphasis on how excellent Universal Design strategies can create an inclusive environment for the public in Singapore.

In Summary

The Singapore High Court on 16 March 2016 decided that the Developer, Architect and Main Contractor of a construction project could rely on the defence of being independent contractors in a claim in tort against them for building defects, such that they were not liable for the alleged defects in tort.

Society Of Construction Law (Singapore) Annual Construction Law Conference 2016 – “Construction Law In Singapore: A Special Case”

Overview

On 4th August 2016, Darren Benger, Chairman of the Society of Construction Law (Singapore) welcomed the participants to SCL(S) annual construction law conference at Hotel Fort Canning which this year was structured in a format of debate, presentations and panel discussions. This full day conference brought together about one hundred and forty participants - legal practitioners, in-house counsel and other professionals from the construction industry from around the region - to discuss the central theme of specialisation in construction law and other trending construction topics.
