Building on the strength of the community of Societies of Construction Law, this 2nd “Focus on Asia” Conference will bring together thought leaders from across the region to share with us recent innovative and expansive developments across the entire life-cycle of international construction projects that impact on all members of any project team - including the construction lawyers!
SCL (Singapore) is pleased to have Sir Vivian Ramsey grace the occasion as our Keynote Speaker.
Participants will explore current trends, latest developments and the future direction of construction industry regulation across the region as well as the challenges and opportunities, across the supply chain, presented by current and planned major projects in Asia.
This Conference aims to bring together senior legal practitioners, in-house counsel and construction industry stalwarts from around the region to discuss the future of our industry as well a platform to network informally with delegates and speakers.

Details of the Keynote Address and Discussion Sessions:

KEYNOTE ADDRESS: REACHING OUT TO THE WORLD: HOW ASIA LEADS THE WAY

As the Asian economies grow and seek new opportunities outside the region, Sir Vivian reviews the way in which economic, cultural and legal developments over the past ten years have changed the world’s perspective on Asia. Western economies which, in the past, sought opportunities for growth in Asia are now met with an equal and opposite flow of resources. Equally, economic development in countries which are less developed has provided opportunities for inward investment from Asia. These changes mean that the worldwide construction industry is facing increasing competition from Asia. These new economic challenges lead to new risks which, as Sir Vivian will explain, require novel solutions in terms of forms of contracts, funding arrangements, risk allocation and ways of resolving disputes.

SESSION 1: “THE BELT AND ROAD INITIATIVE – THE WHATS, WHYS AND HOWS OF THE WORLD’S MOST AMBITIOUS INFRASTRUCTURE PROJECT”

The Belt and Road Initiative is one of the most overt manifestations of China's growing influence and leadership in the fields of international trade, investment, and development of mega-infrastructure well beyond its own borders. But what is the BRI’s rationale? Who is it aimed at benefitting, and how? How has it been received? How are contracts procured and financed? What opportunities, risks and challenges does it create for us? Join our panel of experts as they embark on a multi-faceted exploration of the socio-economic, political and legal complexities surrounding the World’s most ambitious infrastructure project.

SESSION 2: “INFRASTRUCTURE OPPORTUNITIES & CHALLENGES IN ASIA”

Infrastructure Asia (part of Enterprise Singapore) and Asia Development Bank indicates that by 2050 urban population is expected to increase by 90 million in South East Asia and 2.5 billion around the world, and up to 2030 US$ 3.1 trillion in infrastructure investment (including from the increase demand for infrastructure and services, especially in areas such as energy, urban solutions, water and sanitation, transportation and social infrastructure) will be needed.

This session (in keeping with the keynote address by Sir Vivian Ramsey on the topic of “Reaching out to the World: How Asia leads the Way) will have industry experts consider and discuss the Opportunities and Challenges facing Asia with the surge in infrastructure projects and the Belt and Road Initiatives (BRI), including:

1. Public and private sector procurement, financing and investments for such projects;
2. Life cycle including executing, managing (including with technology) and dealing with complication that arise from complex projects; and
3. Consider whether there is currently and, in the future, a comprehensive infrastructure ecosystem that is being applied and could well be considered

SESSION 3: “DEBATE ON THE MOTION: "IN GENERAL, CONSTRUCTION CONTRACTS TEND TO ALLOCATE PROJECT RISKS TO THE MOST APPROPRIATE PARTY”

Risk allocation in construction contracts has been the subject of considerable debate in the construction industry. Accurate risk identification and a fair and equitable allocation of risk are thus essential to ensuring the successful delivery of a project.

Join us in a rare treat as five of the very brightest lights in the field of Construction Law tackle one of the industry’s most controversial issues, in a light-hearted debate filled with wit, fun and humour!

SESSION 4: “LATEST REGIONAL DEVELOPMENTS IN CONSTRUCTION LAW”

This session presents a multi-jurisdictional review by the regional SCLs of developments (in the panelist’s own jurisdiction) of construction law, including case law and statutory law in construction law and in related law with regards to:

• Matters of interest and impact
• Current trends including dispute resolution
