Council Member's Message

Dear SCL(S) members,

It is with great pleasure that I get this opportunity to welcome you all to the 41st edition of the SCL(S) Newsletter.

By the time this newsletter hits your respective desks, we would have just held our AGM & Annual Dinner and I hope that we would have all recovered from any post-Annual Dinner hangovers! As we continue into a busy and exciting period of the year for the Society, with our flagship event coming up in the form of the 2nd Focus on Asia Conference 2019 (11-12 September 2019), I would like to urge those that haven’t yet, to register for the event to avoid any disappointment of missing out.

In this edition of the newsletter, you will find an informative article contributed by Joanna Seetoh and Jason Yong from Pinsent Masons MPillay LLP, titled ‘Only Speak When Necessary – Clarification of the Duty to Speak Under the Building and Construction industry (Security of Payment) Act’. The article reviews the recent case of Far East Square v Yau Lee Construction (Singapore) [2019] SGCA 36...

Announcement

Interim Update on the Survey on Expert Joint Statements in International Arbitration

Thank you for the responses received so far to a survey on the use of expert joint statements in international arbitration.

The SCL (S) has received more than 20 responses, and are in the process of digesting the helpful comments and results.

We note that the vast majority of respondents have suggested that it would be useful to have a prescribed protocol or guidance on producing experts' joint statements.

The SCL (S) has heard you, and will be taking steps to take this forwards, in coming up with some guidance in this area.

Please watch this space for developments.

Council Member, SCL (Singapore)

Far East Square v Yau Lee Construction (Singapore)

A. Introduction

1. In the recent case of Far East Square v Yau Lee Construction (Singapore) [2019] SGCA 36 ("Far East"), the Singapore Court of Appeal ("SGCA") clarified the scope and limits of a respondent's obligation to raise all jurisdictional objections under the Building and Construction Industry (Security of Payment) Act (Cap 30B) ("SOPA").

2. Revisiting its earlier decision in Audi Construction v Kian Hiap Construction [2018] 1 SLR 317 ("Audi Construction"), the SGCA has now provided...

Cost and Time Blowouts (and Major Disputes) on Large Construction Projects

(03 July 2019)

On 3 July 2019, I had the pleasure of chairing a talk given by the charismatic Mr Simon Bellas and the highly experienced, "legendary" Mr John Cooper, both of whom had been working on some of the very largest infrastructure projects and disputes arising from those projects.

After my initial clarifications that we were not talking about a large feast (or for that matter, hair treatments), the speakers drew on their experiences and spoke to the packed auditorium on...
