Rewiring for Complexity: A Briefing on the Integrated Appropriate Dispute Resolution Framework (INTEGRAF)” (14 August 2024)
On August 14, 2024, the Society of Construction Law (Singapore) hosted a highly anticipated seminar titled "Rewiring for Complexity: A Briefing on the Integrated Appropriate Dispute Resolution Framework (INTEGRAF)." The event provided a detailed analysis of the Singapore Mediation Centre's (SMC) new INTEGRAF scheme for dispute resolution. Presented by Mr. Chow Kok Fong and co-chaired by Ms. Joanna Seetoh and Mr. Lee Chau Ee, the seminar focused on two key mechanisms within the framework: (a) the Standing Conflict Avoidance Board (CAB) and (b) Ad-Hoc Conflict Management, which is for parties who may be less familiar with or experienced in alternative dispute resolution (ADR) methods.
The presentation illustrated how the CAB can effectively manage complex disputes by offering real-time proactive advice, facilitating discussions and negotiations, conducting mediation, and providing opinions and determinations when necessary. With timely and effective management from the CAB, coupled with the adaptable and integrated use of ADR methods, parties are better equipped to prevent or quickly resolve disputes.
The briefing also highlighted several key advantages of the INTEGRAF framework, including its ability to mitigate adversarial conflict, its adaptability in applying various ADR methods, and its structured approach to unbundling disputes and selecting the most appropriate resolution method for each aspect. Even when disputes cannot be fully resolved, INTEGRAF works to minimise or contain conflicts, leaving only the most intractable issues for adversarial resolution. Mr. Chow emphasised the framework's versatility and its application at any stage of a dispute as crucial benefits for maintaining and managing business relationships.
During the Q&A session, Mr. Chow explained that parties can either include the INTEGRAF model clause in their contracts, customising it as needed, or opt for Ad-Hoc Conflict Management by contacting SMC with their dispute details to initiate the process. The seminar concluded with a heartfelt thanks to Mr. Chow for his insightful presentation, the co-chairs for leading the discussion, and all attendees for their active participation in this sell-out event. The insights shared during the briefing reinforced INTEGRAF's innovative approach to managing complex commercial conflicts efficiently. Following the presentation, attendees had the opportunity to network and discuss the framework in more detail.
