The Dog Ate My Homework: Adverse Weather, Governmental Delay, Illegal Performance, "Outbreak" and Other Excuses (12 Apr 2024)
Introduction
The seminar was well-attended, with more than 40 people making up the audience. Kelvin and Joanna covered a range of topics relating to events of discharge - from frustration and force majeure to illegality.
The speakers covered how the courts have looked at natural weather disasters, pandemics, delays in obtaining government approvals and other events which contractual parties do not anticipate. Analogies were drawn with the sand ban cases of the past, and the point made is that whether an event discharges parties of their obligations requires nuanced analysis.
All in all, it was an enjoyable seminar, and we thank Kelvin and Joanna for their time.
