Construction Law 101 (14th Run): Sessions 1 - 4 (19, 21, 26 and 28 March 2024)
The 14th run of SCL(S) Construction Law 101 course was held over four evenings on 19, 21, 26 and 28 March 2024.
Construction contracts are often lengthy, and sometimes intimidating and unwieldy to the uninitiated. Adding a further layer of complexity, the construction contracts sit alongside the Security of Payments legislation. The 101 course was therefore designed for participants in the construction industry, to explore the basic principles of construction law in a digestible yet comprehensive manner.
This year’s teaching faculty comprised Mr Toh Chen Han, Mr Ang Wee Jian, Mr Chan Yong Neng, Mr Tan Hai Song and Ms Wynne Tay, from Pinsent Masons MPillay.
To provide a foundational overview, Session 1 covered various key principles underpinning construction contracts, including the concept of completion, extensions of time for completion and liquidated damages.
Session 2 shifted focus towards the personalities and individuals involved in administering the construction contracts. It addressed the principles that govern the relationship between employers and contractors in construction projects, and other parties that tend to play a part in delivery of projects including subcontractors and certifiers.
Claims and disputes between parties are often invariably on many construction projects. Session 3 spotlighted on notice requirements under standard form contracts, and various dispute resolution forums and their inter-relationship.
Session 4 concluded with an examination of the security of payment adjudication regime in Singapore, reflecting on practical issues arising in the adjudication of construction disputes and providing an overview of the adjudication process.
Each session was also accompanied by a buffet dinner, and casual networking, which proved to be a hit. All buffet trays were left empty each evening.
We thank the attendees for their participation and lively discussion, and the teaching faculty for another successful run of the course.
