Cross Fertilisation - New Zealand Developments In Construction Law And Adjudication (20 October 2008)

As sister Common Law jurisdictions, New Zealand and Singapore can learn from each other. Reference to decisions in the other jurisdiction is common in the judgments of the courts of both countries.

In this paper Tómas Kennedy-Grant, QC, author of “Construction Law in New Zealand” and co-author of “A guide to the Construction Contracts Act” and a member of The Arbitration Chambers Singapore, will talk about recent New Zealand decisions in the field of construction law (decisions on the duty of care of developers, engineers, contractors, local authorities and other public bodies, and directors of companies and on the availability of specific performance as a remedy for breach of a construction contract) and will provide a review of the decisions on the Construction Contracts Act 2002, the New Zealand equivalent of Singapore’s Building and Construction Industry Security of Payment Act (Cap 30B).
