Following on from the highly successful construction law update seminar in January 2011, SCL (Singapore) is pleased to present its must-attend annual overview of key legal issues affecting the construction law industry in Singapore this past year.

Our distinguished speakers, Mr. Chow Kok Fong and Mr. Ho Chien Mien will discuss the latest developments in the statutory adjudication regime under the Security of Payment Act and other significant legal developments that have had an impact on the construction industry in Singapore.

Developments in Singapore Building And Construction Law In 2011

  • The right of an employer to set off against monies due to a contractor, the estimated costs of rectification works, etc., and whether the said costs must be quantifiable at the time of exercising the right of set-off (Engineering Construction Pte Ltd v Sanchoon Builders Pte Ltd [2011] 1 SLR 681; [2010] SGHC 293)
  • The legal validity of a fixed charge created over a building agreement – discussed for the first time by the Singapore Courts (Jurong Data Centre Development Pte Ltd (provisional liquidator appointed) (receivers and managers appointed) v M+W Singapore Pte Ltd and others [2011] 3 SLR 337; [2011] SGHC 58)
  • Limitation period for service of a payment claim under the Building and Construction Industry Security of Payment Act (Chua Say Eng v Lee Wee Lick Terence, [2011] SGHC 109)
  • Delays in the completion of works – the Singapore Court addresses the issues of when time is set at large and when liquidated damages provisions survive the termination of contract (Lim Chin San Contractors Pte Ltd v LW Infrastructure Pte Ltd [2011] SGHC 162; LW Infrastructure Pte Ltd v Lim Chin San Contractors Pte Ltd [2011] SGHC 163)
  • Singapore Court of Appeal clarifies the duties and responsibilities of a resident technical officer (a.k.a. the Clerk of Works) (Animal Concerns Research & Education Society v Tan Boon Kwee [2011] SGCA 2)
