In conjunction with the Keynote address made by the Honourable Justice Quentin Loh at the SCL(S) Annual Construction Law Conference on 25 July 2012, this talk will explore the use of Expert witnesses in Construction Disputes.
Our speakers will share some practical guidance from their experience in the UK courts and in international arbitrations with a view to ensuring that
experts are used in the best possible way and that the all-too-common pitfalls are avoided.
In particular the talk will cover:
• The role of the expert (including differing approaches in different jurisdictions)
• Expert meetings
• Presenting the evidence – reports and joint reports
• Presenting the evidence at the hearing - evidence in chief, cross examination, expert conferencing/concurrent evidence
• Expert determination
• Some examples of when it all goes wrong
