The issue of concurrency and how to address it is becoming increasingly important in complex construction and engineering disputes.  Franco Mastrandrea (arbitrator, adjudicator, expert) and Steve Briggs (arbitrator, mediator, expert) are two of the most experienced practitioners in international dispute resolution and will present their views in a debate that will encompass the following:

  • What is concurrency anyway?
  • ‘But for’ and ‘sufficient’ causes
  • The concept of the ‘same damage’: project delay and project prolongation
  • The relevance/importance of the prevention principle
  • How to deal with concurrency from a time perspective
  • How to deal with concurrency from a cost perspective: can it all be reduced to a ‘but for’ test?
  • Trends in English/Scottish/international law
  • Is there a better way?
