About this Seminar:
Although this presentation will focus on NEC3 (and the more recent NEC4), the collaborative/cooperative mechanisms referred to can be incorporated into traditional forms of contract to make them more effective in terms of proactive risk management and avoidance/mitigation of what would otherwise be time and cost overruns. In particular, the importance of having an agreement between the contracting parties to work together to identify, mitigate and compensate for risk events in a proactive and business-like manner will ensure that their respective obligations under the Contract can be fulfilled.
The presentation will also include the recent adoption by NEC4 of dispute avoidance systems used by contracts such as FIDIC to underpin the effectiveness of mandatory cooperation under NEC.

About the Speaker:
Mr. John Battersby - Group Managing Director, BKAsiaPacific Limited
Mr. John Battersby, FCInstCES, FGIS, FASI, FCIOB, FHKICM, MRICS, MHKIS, FCMI, FCIArb, FHKIArb, MAE, RPS(QS) is Group Managing Director of BKAsiaPacific Limited and a Registered Professional Quantity Surveyor (Hong Kong) and Chartered Construction Manager having worked in the construction industry for 52 years, 36 years of which have been spent working on projects in Hong Kong, China and South East Asia (including Singapore).
John has acted as an expert witness several times, both in arbitration and litigation, in respect of additional cost/loss and expense/damages claims, measurement issues, adjustment of rates, valuation of variations and causes and effects of delays to construction works. He has acted both as party appointed expert and “single joint expert” (or “tribunal expert”). He is a Practising Member of the Academy of Experts and accredited by the Academy as an Expert. He has also been appointed as Arbitrator, Assessor, Adjudicator, Mediator and Dispute Resolution Advisor several times.
From his first hand experience of what can go wrong on various building and civil engineering projects, John understands the importance of dispute avoidance through collaborative/cooperative contracting. He has also worked on target cost contracts utilizing collaborative/cooperative working procedures as well as NEC lump sum and measurement contracts and has conducted numerous seminars and workshops on these subjects.

Adrian is a seasoned energy, infrastructure and construction lawyer. He is qualified in both English and Singapore law. Adrian has provided comprehensive and integrated advice on all aspects of energy and infrastructure project development as well as in relation to acquisitions and disposals. These range advising equity sponsors investing into projects, government authorities granting project concessions; lenders providing project financing (and other forms of financing) to projects, EPC contractors, feedstock and utilities suppliers and potential offtakers and O&M service providers.
His previous role as an in-house legal counsel for a multi-national energy company, gives him a particular depth of insight into the energy sector as well as a clear understanding of the business needs of clients. Adrian has particular in depth understanding and practical experience across Asia, having supported clients on projects in Singapore, the Philippines, Indonesia, Vietnam, Malaysia, Thailand, Sri Lanka, Myanmar and Mongolia.
