Events Calendar
These temporary measures will not be in place indefinitely, and, are currently due to expire on 20 October 2020 (unless further extended). It is crucial that practitioners and in-house counsel stand prepared and are not caught unawares. In the context of construction disputes, issues relating to breach of contract, liquidated damages and calling on performance bonds are often complex inquiries and will no doubt be complicated further by COTMA.
This seminar focuses on the aftermath of the moratorium under COTMA and, amongst others, the following issues which may arise:
- the difficulty in determining whether the non-performing party has met the requisite 'materiality' threshold to qualify for relief under the COTMA;
- the uncertainty in the scope of construction contracts to which the COTMA applies; and
- the problem presented by multiple causes of delay and disruption to construction projects arising both during and after the prescribed period, some of which may be unrelated to the COVID-19 pandemic.
