What if our perceptions around how risks eventuate on major construction projects is inconsistent with how projects fail in practice? And what if the way we currently separate risk, in terms of legal risk, commercial risk and technical risk, is an artificial divide that has the potential to increase our risk exposure, rather than decrease it?

This presentation asks how the world of complex systems thinking can provide us with a different perspective on how we set up, deliver, and manage risk on construction projects.

We examine:

• how past failures occurred precisely because a complex systems approach wasn’t considered
• how real-world systems defy our attempts to control them, and
• how our understanding of apparently unrelated phenomena, like the reasons why birds flock, can inform us about how to run better construction projects.

Adopting a complex systems thinking approach is not simply a new tool for those involved in the industry, it’s an altogether different model for understanding the world.

About the Speaker:
Dr. Sean Brady – Managing Director, Brady Heywood

Dr Sean Brady is forensic engineer that has acted as an expert witness on numerous occasions, and he is the managing director of Brady Heywood, a firm that works with business, government and the legal sector to understand and resolve complex issues that typically require a whole of system approach. Sean completed the Brady Review, an investigation into the causes of fatalities in the mining industry in Queensland, Australia. This review analysed 20 years of incident and fatality information, was data driven, and culminated in 11 recommendations for both industry and the regulator on how to lower the fatality and incident rate. Sean is currently engaged as the lead investigator on a major power station incident in Australia. Sean speaks, podcasts, and writes about failure, human behaviour, data analytics and engineering disasters.

A seasoned litigator, Chen Han has been described by Legal 500 as ‘very methodical’, ‘forceful and relentless in his cross-examination' and ‘a go-to individual for complex delay claims’, who is ‘unafraid to dive into details’. He acts as Counsel in international arbitrations, and in Singapore's High Court and Court of Appeal proceedings and has acted on major infrastructure projects e.g. the construction of power plants in Borneo, Pakistan, the Philippines and South Africa, international airports in India and Vietnam, the Red Line Commuter Train Project in Thailand, an iron-ore processing plant in Russia, and numerous large-scale projects in Singapore including the iconic Marine One development, Changi Airport, Sports Hub, Tuas Desalination Plant 3, Deep Tunnel Sewerage System Phase II, Lower Seletar Water Works, Changi Water Reclamation Plant Phase 2, Biopolis, Fusionopolis, Kallang-Paya Lebar Expressway, the Thomson,  Eastern Region, and Jurong Region mass rapid transit lines. Chen Han is the Immediate Past Chair of the Society of Construction Law (Singapore), a Fellow of the Singapore Institute of Arbitrators, a Contributing Editor for Singapore’s leading construction law textbook, Law and Practice of Construction Contracts (Chow Kok Fong, 2018), and a Contributing Editor for the Singapore Journal of Construction Law..
