About this Seminar
The SCL (Singapore) is proud to present the 2024 edition of the Annual Construction Law Update. As with previous editions, the seminar will cover developments in the area of construction law in Singapore and England in the preceding year. The speakers are Mr Melvin Chan and Mr Simon Hughes, KC
Mr Melvin Chan will provide an overview of the recent developments in adjudication under the Building and Construction Industry Security of Payment Act and the latest construction law cases in Singapore over the past year.
Mr Simon Hughes, KC will provide a review of the developments in England and relevant decisions elsewhere.

About the Speakers:
Mr. Melvin Chan - Partner and Head of Litigation and Dispute Resolution, TSMP Law Corporation
Melvin is a partner in TSMP’s Litigation and Dispute Resolution Department, and co-heads TSMP’s Construction & Engineering practice. His main area of practice is in corporate and commercial litigation, where he has extensive experience in construction and engineering disputes, both in Court and arbitration. In the field of building construction litigation, Melvin has successfully argued a number of landmark decisions in the High Court and Court of Appeal on duties of care owed by contractors and consultants, and the independent contractor defence; and more recently in Denka Advantech Pte Ltd and anor v Seraya Energy Pte Ltd and anor [2020] SGCA 119, where the Court of Appeal reaffirmed the Dunlop test for liquidated damages. Melvin is an Accredited Adjudicator with the Singapore Mediation Centre and a Fellow of the Singapore Institute of Arbitrators, and is consistently recognised as a leading practitioner for his work in Construction and Engineering in leading legal publications. |
Mr. Simon Hughes KC – Barrister, Keating Chambers (London)
Simon Hughes KC is a specialist silk in major construction, engineering, shipbuilding and other off-shore and energy related disputes was recently awarded “Construction and Energy Silk of the Year” for 2019 by the Legal 500. He comes recommended for his client-focused approach, understanding of the technicalities of disputes and his “exceptional” advocacy, cross-examination, and advice. Simon has acted on some of the largest, and most challenging, heavy civil engineering disputes of the day (including a great deal of highway/highway infrastructure and associated geotechnical work). Simon is ranked in the ‘Star’ category in Chambers & Partners for Construction and is ranked highly in Chambers & Partners (Band 1) for International Arbitration. There are only few silks with these dual top-ranking and this reflects Simon’s stellar practice for major clients and leading law firms. Simon has been involved in disputes involving most standard form contracts used for substantial projects including the JCT standard forms, ICE 5th and 6th editions, the NEC, IChemE, FIDIC (Green, Red, Yellow and Silver Books), and derivative standard form agreements. |
About the Chairperson
Mr. Trevor Lam – Director - Asia, TBH; Vice Chair, Society of Construction Law (Singapore)
Trevor is the Vice-Chairman of the Society of Construction Law (Singapore). Trevor has over 23 years of experience across the globe and is currently a Director of TBH’s Asia business. He is a construction planner and delay expert. His experience has been built on a variety of projects including data centres, airports, roads, rail, mixed-use developments, hospitals, shopping centres, oil & gas, power and sporting facilities. Over his career, he has been engaged in the provision of independent expert analyses on extensions of time, disruption and acceleration. This has included the preparation of analyses, reports and acting as the Expert for litigation, arbitration, adjudication and mediation proceedings. To stay current, Trevor continues to maintain a strong involvement in the delivery of live projects; planning works from conception to completion across a diversified client base including owners, contractors and subcontractors. As a result, it has helped in developing a wide-ranging perspective on construction issues that commonly arise. |
