Strata-titled developments are fertile ground for complex legal disputes. This seminar dives into the evolving legal landscape involving Management Corporation Strata Titles (“MCSTs”). Kelvin will examine claims brought by MCSTs against developers and contractors for building defects — a critical intersection of construction law and strata governance. Daniel will address disputes between MCSTs and individual residents, including issues of by-law enforcement, maintenance, and governance. Tailored for construction lawyers and technical professionals, this session unpacks key legal principles, recent case law, and practical strategies in managing the legal and technical challenges of strata property disputes.

About the Speakers
Ms. Daniel Chen – Partner, Litigation & Dispute Resolution, Lee & Lee

Daniel Chen is a Partner in the Litigation and Dispute Resolution Department of Lee & Lee. Daniel has extensive experience in disputes involving Management Corporations and Strata Law, representing both Management Corporations and Subsidiary Proprietors in matters before the Courts and Strata Titles Boards. Some of his recent matters include The MCST Plan No. 2005 v Tan Wei Loong and another [2024] SGSTB, MCST Plan No. 2785 v Ng Jun Quan (Huang Junquan) [2024] SGDC 150, MCST Plan No. 1788 v Lau Hui Lay William and Anor [2023] SGHC 284, Soo Hoo Khoon Peng v MCST Plan No. 2906 [2023] SGDC 162; [2023] SGHC 355, Liu Xiaoyu v Sub-MCST Plan No. 4391 STB 41 of 2023, Manohar K D Nanwani v MCST Plan No 1884 [2023] SGDC 40. |

Kelvin Chia graduated from the National University of Singapore with a Bachelor of Laws, LL.B (Hons), in 1994, and was admitted as an Advocate & Solicitor, Supreme Court of Singapore, in 1995. Since then, he has practised as a civil litigator, with a particular emphasis on building and construction litigation, arbitration and adjudication. After working in a number of small to medium-sized law firms, Kelvin set up his own practice under the name of “Lumen Law Corporation” in 2015. In addition to counsel work, Kelvin is an Adjudicator under the Building & Construction Industry Security of Payment Act 2004, and an Associate Mediator with the Singapore Mediation Centre and under the Law Society Mediation Scheme. He was instructed counsel in one of the largest claims by a Management Corporation for defects arising in a condominium development (see Management Corporation Strata Title Plan No. 3322 v. Mer Vue Developments Pte Ltd & Ors (King Wan Construction Pte Ltd & Ors, third parties) [2016] 2 SLR 793). |

Mr. Damien Xing - Senior Lecturer, National University of Singapore; Council Member, Society of Construction Law (Singapore)
Damien Xing is a Senior Lecturer at NUS Business School, where he teaches and writes on company law and applied contract law. In addition, he maintains a practice as counsel at Covenant Chambers LLC. He has acted for contractors and subsidiary proprietors in legal proceedings against MCSTs, including in Sit Kwong Lam v MCST Plan No 2645 [2018] 1 SLR 790, which remains the most authoritative decision on the interpretation of “common property” under the Building Maintenance and Strata Management Act. |
