Dear fellow SCL(S) members, 

A warm welcome to the 2nd issue of our newsletter in 2023.

As our members progressively return to their offices and get used to navigating through the crowds, we have increased the number of in-person professional development and networking events relative to the virtual ones.

We held a successful networking event on 1 March 2023 at Savanh Bistro & Lounge with 91 attendees which provided great opportunity for our members to connect with a variety of guests from the construction industry. On that note, we thank our sponsors Secretariat and RHTLaw Asia for their support. We also hosted our flagship Construction Law 101 (13th Run) course in person on 21, 23, 28 and 30 March 2023.

We continue to strive to provide utmost value to our members through the upcoming webinars, seminars and newsletters. In that respect, we are very much looking forward to the upcoming webinar on 26 April 2023 on Disruption, where our fellow speakers will discuss the grounds, methods and proof required to mount a successful claim. We are also organising a seminar in relation to SAL guide to collaborative contracting, which will be held in the 3rd week of May 2023.

In this Conference, the International Statutory Adjudication Forum (ISAF) will unveil its proposed Model Law On Statutory Adjudication, which draws upon the experiences of international practitioners from across the globe. The intention of the Model Law on Statutory Adjudication is to provide states who are considering the enactment of a statutory adjudication regime with a draft law which embodies best current practice which may be either adopted or adjusted to suit local conditions. The speakers will also share their experiences on collaborative contracting forms and processes, and their reflections on their efficacy in the avoidance and resolution of disputes in the construction industry. For more details, please click HERE

When is a Written Instruction not a Condition Precedent for a Successful Variation Claim?

In Vim Engineering Pte Ltd v Deluge Fire Protection (S.E.A.) Pte Ltd [2023] SGHC(A) 2 (“Vim Engineering AD”), the Appellate Division of the High Court reversed the High Court’s decision in Vim Engineering Pte Ltd v Deluge Fire Protection (SEA) Pte Ltd [2021] SGHC 63 (“Vim Engineering HC”), holding that a clause stipulating that variation works shall only be carried out with the written instructions of the main contractor’s project manager does not require the presence of a written instruction as a condition precedent to a....

Construction Law 101 (13th Run): Sessions 1 - 4 

(21, 23, 28, 30 March 2023)

SCL(S) hosted the 13th run of SCL(S) Construction Law 101 course over four evenings from 21 to 30 March 2023.

The 101 course is designed for participants in the construction industry, to explore basic principles of construction law. Each of the four sessions were respectively led by Mr Tan Hai Song, Mr Ang Wee Jian, Mr Toh Chen Han and Mr Chan Yong Neng, from Pinsent Masons MPillay.


The first session provided an overview of important general construction law concepts. Various key principles underpinning construction contracts were examined, including the concept of completion, extensions of time for completion  and liquidated damages.

Session two then explored basic principles that govern the relationship between employers and contractors in construction projects, and other parties that tend to play a part in delivery of projects including subcontractors and certifiers. The way that the SIA and PSSCOC form of...

Networking Cocktails 2023

(1 March 2023)

I recently had the pleasure of attending the Society of Construction Law Singapore’s Networking Cocktails event on March 1st, 2023, held at the Savanh Bistro & Lounge by Indochine. The event was a perfect blend of relaxed informality, delicious cuisine and a great opportunity to meet and network with various industry professionals.  

Representatives from many esteemed companies attended the event. The Vice Chairman of SCL(S) started the evening by thanking the sponsors and the delegates for their generous support and for attending in such great numbers.

Throughout the evening, there was a real sense of community among the guests, with many of them taking the opportunity to catch up with old friends and colleagues and to  make new connections with other professionals in the industry. We were able to mingle and enjoy a variety of cocktails and appetisers while discussing...
