Construction Law 101 (13th Run): Sessions 1 - 4 (21, 23, 28, 30 March 2023)
SCL(S) hosted the 13th run of SCL(S) Construction Law 101 course over four evenings from 21 to 30 March 2023.
The 101 course is designed for participants in the construction industry, to explore basic principles of construction law. Each of the four sessions were respectively led by Mr Tan Hai Song, Mr Ang Wee Jian, Mr Toh Chen Han and Mr Chan Yong Neng, from Pinsent Masons MPillay.
The first session provided an overview of important general construction law concepts. Various key principles underpinning construction contracts were examined, including the concept of completion, extensions of time for completion and liquidated damages.
Session two then explored basic principles that govern the relationship between employers and contractors in construction projects, and other parties that tend to play a part in delivery of projects including subcontractors and certifiers. The way that the SIA and PSSCOC form of contracts manage subcontractor appointments, and the duties of certifiers, were amongst the principles discussed.
Disputes invariably arise in many construction projects. Session three thus provided an overview of key principles that arise in the context of disputes between the parties, including notice requirements under standard form contracts, and various dispute resolution forums and their inter-relationship.
The 101-course concluded with session four that examined the security of payment adjudication regime in Singapore, reflecting on practical issues arising in the adjudication of construction disputes and providing an overview of the adjudication process.
More than 50 delegates joined the teaching faculty over the four sessions, providing for lively and engaging evenings of learning.
