Honorary Secretary’s Message - April 2024



Dear SCL(S) members and followers, 

We are well into the Society’s calendar for the year and are thrilled to present the latest edition of our newsletter. Do take some time to peruse the articles and updates as well as some news about our upcoming events.

Some highlights of our calendar since our last newsletter include our regular round of Networking Cocktails (28 February 2024) which (consistent with previous occasions) was very well attended. It is great to see members and friends of the Society come together to forge bonds of friendship over light food and drink. We also ran the 14th edition of our ever popular Construction Law 101 course (held at the end of March) which is aimed at equipping attendees with foundational principles in construction law.

Our calendar continues to be packed with various seminars and events.

As we look forward towards the second half of the year, I would like to particularly mention our upcoming Annual Conference. A highlight of the Society’s calendar, this year’s Conference will be held on 2 October 2024 and is titled “Singapore Inc - Staying Best in Class in Construction?”.

As may be alluded to in the title, the Conference will focus on the construction industry in Singapore and explore a range of topics ranging from examining opportunities and challenges in the energy transition, managing disruption and uncertainty in the construction industry and navigating the management of delay experts in proceedings. Some light hearted moments will also be expected with a debate on the role of artificial intelligence in construction projects. Judicial Commissioner Alex Wong has kindly agreed to grace the occasion as our Guest of Honor. So do mark your calendars for what promises to be a lively and meaningful congregation of construction industry stakeholders. We look forward to seeing you there!

Inflation In Construction Projects

Inflation is an economic concept that refers to an increase in the price of goods and services in an economy. It typically is expressed as a percentage rate over a period of time. The rate of inflation varies depending on the state of the global economy and the macroeconomics of individual countries.

Simply put, as inflation increases the average price of goods and services rises, which in turn decreases purchasing power. The reverse is also true, as inflation decreases, spending power increases.  Increases in inflation can have a significant impact on the cost outcome of construction projects due to the global nature of the industries' supply chain.

Singapore High Court Clarifies the Lodgement Period of Adjudication Applications

Introduction 

The Appellate Division of the Singapore High Court has clarified when an adjudication application under the Building and Construction Industry Security of Payment Act 2004 (2020 Rev Ed) (the “SOPA”) should be lodged.

In affirming the position established by the General Division of the Singapore High Court, the Appellate Division has clarified that the commencement of the seven-day period to file an adjudication application made under s 13(3)(a) of the SOPA excludes the day the entitlement arises under s 12(2) of the SOPA.

The Dog Ate My Homework: Adverse Weather, Governmental Delay, Illegal Performance, "Outbreak" and Other Excuses

The seminar was well-attended, with more than 40 people making up the audience. Kelvin and Joanna covered a range of topics relating to events of discharge - from frustration and force majeure to illegality. The speakers covered how the courts have looked at natural weather disasters, pandemics, delays in obtaining government approvals and other events which contractual parties do not anticipate.......

SCL(S) Networking Cocktails 2024

On 28 February 2024, the SCL (Society of Construction Law) Singapore Annual Networking Event took place at Best Brew, Four Points by Sheraton. Over 60 attendees, comprising legal practitioners, industry experts, and enthusiasts in construction law, gathered for an evening of networking.The event served as a dynamic platform for professionals to exchange insights and foster connections within the construction law sphere…..
