About the Seminar:
In December 2012, the Singapore Institute of Architects (SIA) published the SIA ARTICLES AND CONDITIONS OF CONTRACT for MINOR WORKS 2012 (MWC 2012). The MWC 2012 was written to address the unique challenges of smaller projects, often involving lay Employers such as house owners, management corporations, companies carrying out renovations to their own premises, etc., new statutes and the use of electronic communication.
While there are currently no cases involving the MWC 2012, this talk aims to introduce the new features of the MWC 2012 to prepare the dispute resolution fraternity ahead of such cases. This talk will cover:
1. A brief background of the MWC 2012 and SIA Contracts in general
2. The considerations for the updates, including relevant cases at the time
3. Contractual procedures to address common areas of dispute, particularly three significant areas where the MWC
2012 differs from the SIA Building Contract 9th Edition:
- Payment and the SOP Act
- Extension of Time and Liquidated Damages
- Dispute Resolution Mechanisms and Arbitrator's powers

About the Speakers:-
Ms. Catherine Loke – Partner, Lander Loke Architects
Catherine Loke obtained her Bachelor of Planning & Design in 1989 and Bachelor of Architecture (Hons) in 1992 from the University of Melbourne. During the course of her career, she has worked briefly in Melbourne & Kuala Lumpur, and in Singapore since 1993. She has been a Registered Architect since 1998 and partner in Lander Loke Architects since 1999. Catherine currently serves on the Council at the Singapore Institute of Architects, and as Chairman of the Small & Medium Architectural Practice Committee, SIA Minor Works Contract Working Group and the Architects' Appointment Committee. She is currently the Chairman of the Professional Practice Examination Panel at the Board of Architects, and also serves as External Examiner for the Master of Architecture programme, Architectural Practice course, at the National University of Singapore.
In 2011 and 2012, she was the Facilitator of the SIA Minor Works Contract Working Group which undertook a comprehensive review of the SIA Minor Works Contract First Edition 1987, resulting in the publication of the SIA Articles and Conditions of Contract for Minor Works 2012 in December 2012.
Mr. Anil Changaroth – Managing Director, CHANGAROTH CHAMBER LLC
Anil an Arbitrator, Mediator, Advocate and Solicitor of Singapore and Solicitor of England and Wales has been in practice since 1995. Having worked with local firms, in-house and an international firm, he established his Chambers on 1st July 2014, working with clients in the Singapore and the region primarily involved with commercial, civil, corporate & criminal dispute resolution with a focus on construction related mediation, adjudication, arbitration and litigation. Anil is the Honorary Legal Advisor to the Singapore Institute of Architects and is on the SIA's Small and Medium. Architectural Practices Committee's Minor Works Contract Working Group".
About the Chairperson:-
Mr. Darren Benger - Director, ATA Architects Pte Ltd
Darren received his Bachelor of Architecture degree with First Class Honours from the University of Adelaide, Australia in 1995, and registered with the Board of Architects, Singapore in 2001. Darren received the Graduate Certificate in International Arbitration (GCIA) from the National University of Singapore in 2008. Since 1996 Darren has resided in Singapore, and he is currently a director of ATA Architects Pte Ltd. Darren is a Council member of the Society of Construction Law (currently as Chairperson for the 2014/15-2015/16 term); a Fellow member of the Singapore Institute of Arbitrators; and is currently a member of Council of the Singapore Institute of Architects (since the the 2007/08 term). Darren’s involvement in the Singapore Institute of Architects also includes participation in various SIA committees, including involvement in the Building Contracts Committee since 2007/08, the Workplace Safety and Health Committee (currently as Chairperson, as well as representing SIA in the WSH Council 'Design for Safety Regulations' taskforce) and the ADR Committee since 2008/09 (as chairperson since 2012/13). Darren is also on the SIA Panel of Arbitrators and the SIA Panel of Expert Determinators. Darren has contributed as a lecturer/tutor to the building contracts module of the Architectural Practice course for the National University of Singapore - School of Architecture (since 2009). Darren has served as an expert witness in various Court cases and arbitrations, including one of the first experts ‘hottubbing’
cases in the SGHC.
