Council Member’s Message - June 2024



Dear SCL(S) members and followers,

It has been a busy first half of the year for SCL(S). We are heartened to have continued to receive your support for our industry events.

There is significant buzz in the community over the past months, with NEC’s release of the secondary option clauses for use in Singapore. On this theme, our newsletter this month is accompanied by an article exploring collaboration in practice under Singapore’s PSSCOC Option Module E and NEC4.

One of the SCL(S) Publication Committee’s goals during our term is to also curate noteworthy regional developments for our readers. HKIAC released the new 2024 HKIAC arbitration rules, which came into effect on 1 June 2024, and an article accompanying our newsletter covers the key notable changes.

Our upcoming events calendar provides plenty of opportunities for learning and mingling. For those who have yet to sign up for our upcoming Annual Dinner at OSO Ristorante on 29 August 2024, I’d strongly encourage you!

HKIAC Launches Updated Arbitration Rules for 2024

The Hong Kong International Arbitration Centre (HKIAC) has released its new Administered Arbitration Rules, which will come into effect on June 1, 2024. The 2024 HKIAC Rules introduce several important changes aimed at enhancing the efficiency and integrity of HKIAC arbitrations. While preserving the overall structure and approach of the well-received 2018 Rules, the 2024 update brings some significant developments.

Collaboration In Practice Under Singapore PSSCOC Option Module E and NEC4

Introduction 

Traditional contracting has, in recent years, come under increasing criticism for being, among other things, unable to handle increasingly complex projects as there is little incentive for employers and contractors alike to innovate and to do more than what is necessary to meet the minimum contractual requirements. This is due largely to the “silo-ed” participants, processes and duties – typical characteristics of traditional contracting models which oftentimes give rise to the tendency for parties to act in their own interests and in an adversarial manner rather than in the interests of the project as a whole. Over time, this can result in delays in information dissemination, and poor communication and cooperation, which in turn negatively affect parties’ abilities to effectively manage the common construction risks that result in disputes instead of managing risks pro-actively and developing mutually acceptable solutions. These implications indisputably reduce productivity by contributing to projects finishing over-schedule, over-budget and being of a lower quality.

Construction Law 101 (14th Run): Sessions 1 - 4 (19, 21, 26 and 28 March 2024)

The 14th run of SCL(S) Construction Law 101 course was held over four evenings on 19, 21, 26 and 28 March 2024.

Construction contracts are often lengthy, and sometimes intimidating and unwieldy to the uninitiated. Adding a further layer of complexity, the construction contracts sit alongside the Security of Payments legislation. The 101 course was therefore designed for participants in the construction industry, to explore the basic principles of construction law in a digestible yet comprehensive manner.

This year’s teaching faculty comprised Mr Toh Chen Han, Mr Ang Wee Jian, Mr Chan Yong Neng, Mr Tan Hai Song and Ms Wynne Tay, from Pinsent Masons MPillay.

We thank the attendees for their participation and lively discussion, and the teaching faculty for another successful run of the course.
