Chairman’s Message - February 2022
Dear fellow SCL(S) members
A warm welcome to the first edition of our 2022 SCL(S) newsletter.
We kicked off this calendar year with our Annual Construction Law Update 2022 on 27 January – we hope those who attended enjoyed it.
As many of you will now know, we are celebrating our 20th Anniversary this year and as ever, thank you so much for your continued support through the years!
The Anniversary Theme and Logo illustrates our continued commitment to sustainability in the construction industry and how it can play a pivotal role in meeting the challenges of COVID recovery and beyond. To celebrate such a historic year, we are planning a series of celebratory events during the course of 2022 including our 20th anniversary membership drive and sponsorship opportunities, details of which are published on the SCL(S) website. In early August, we are planning a virtual Strategic Leadership Dialogue, which event allows all our past Chairs to nostalgically look at each of their two years as Chairs, and the events that impacted them the most during that time and how those events have impacted you and the industry since or may continue to impact you and the industry going forward. Attendance is complimentary for SCL(S) members. Our Annual General Meeting follows thereafter, where a ground-breaking new Business Membership Scheme will be tabled. In October, we will convene our full-day 3rd "Focus on Asia" hybrid Conference with its central theme being sustainability, followed by our 20th Anniversary Gala Dinner.
Our "SCL(S) Environmental Law and Sustainability Focus Group” was set in late 2021 further to discussions with Ms Indranee Rajah (as Second Minister for National Development) to undertake education, study and research in respect of environmental sustainability...

20th Anniversary Celebrations
Thank you for your continued support of SCL Singapore over the years!
We celebrate our 20th anniversary this year and needless to say, we would not be where we are without your support.
An Overview of 20th Anniversary Celebrations
In this our 20th year, we focus on the increasingly critical role of “Sustainability” within the construction industry, as demonstrated through our specially commissioned logo and theme which you will see throughout 2022.

Liquidated Damages: Invalidated by Partial Possession? A Cap on General Damages?
The nature of construction work typically comprise various phases of work, yet more often than not liquidated damages clauses still often only provide for one rate for delays to any phase of work. This could lead to situations where the same liquidated damages rate is applied on later phases of work even where part of the work has been completed. In Eco World – Ballymore Embassy Gardens Co Ltd v Dobler UK Ltd [2021] EWHC 2207 (TCC) ("Eco World"), the Technology and Construction Court ("TCC") in England and Wales ruled that such "one rate" liquidated damages clauses are not void and/or unenforceable even if they do not provide a mechanism for reduced liquidated damages to reflect partial possession of completed works. While there are no reported judgments in Singapore discussing Eco World at the time of writing, it is suggested that this approach is not inconsistent with the freedom of contract principle that is routinely upheld by the Singapore courts....

WEBINAR: Annual Construction Law Update 2022

On 27 January 2022, the Society held its ever popular Annual Construction Law Update. This is the 2nd year running that this event was held virtually due to the COVID-19 pandemic. This webinar was delivered by 2 esteemed construction law practitioners, Ms. Laina Chan (Barrister, Chair, Society of Construction Law Australia; Director, Australian Construction Industry Forum) and Mr. Christopher Chong (Director, Dispute Resolution, Head, Construction & Engineering, Drew & Napier LLC).

Lighthouse Club (Singapore): Xmas Quiz Night
(9 December 2021)
The Lighthouse Club Singapore's December Quiz saw 5 of Santa's teams taking part with 4 Elves each! The coveted top star on the tree was shifting throughout the competition as the five Cheery Christmas themed quiz rounds were delivered effortlessly and with much merriment by quizmaster Sid Bhalla and had the teams delving into the eggnog fudged memories of Christmas past to remember what was the name of the guardian angel who takes George Bailey on his journey and did the first mince pies contain meat or not????
A Christmas carol round had the elves taking part in singing the hymns (ok guv ;)) and double points for all teams were up for grabs in the...
